Edward Settle

M, (c 1740 - 1 May 1793)
Father*William Settle (circa 1710-1782)
Last Edited6 Aug 2005
Edward Settle married Roseanna Morgan, daughter of William Morgan. Edward Settle was born c 1740.1 He was the son of William Settle. Edward Settle died on 1 May 1793.1
In 1795, William Settle petitioned Chancery Court, saying:
"... complaining sheweth unto your Worships Your Orator William Settle
"That his father Edward Settle late of the County of Fauquier some time in the year 1792 [the 2 may have been written over another figure] departed this life intestate possessed & seized of an estate both real and personal leaving a widow nine children Viz. your Orator who is now of full age, and Francis Settle, John Settle, Edward Settle, Sally Settle, Betsey Settle, Nancy Settle, Samuel Settle, & Polly Settle all infants under the age of twenty one years, that Rozanna Settle the widow of the said Edward Settle, Administratered upon his Estate and still keeps the whole of the said Estate in her possession, and no distribution of the same has yet been made altho all the debts due from him have been discharged, nor hath the Dower of the said Rosanna been alloted her or a settlement made of the Administration Account, Your Orator therefore prays that by a Decree of Your Worships Commissioners may be appointed to settle this --??-- account of the said Rosanna Settle to lay off her Dower in the Estate of the said Edward Settle, and to lay off and divide the residue of this said Estated according to Law among his Representatives, as the administratrix is willing and consenting thereto and your Orator ready to enter into bond as the Law directs to indemnify her against the said estated so far as his proportion of the distribution may extend and your Orator will pray etc.

"John Mauzey, Clark Kemper, Fauntleroy Dye & Francis Settle."2 In 1797, William petitioned the court to be allowed to settle the estate of Edward Settle, deceased. Roxanna had taken on the administration of the estate and William was now of age. The other heirs of Edward Settle were Francis, John, Sally, Edward, Nancy, Betsey, Samuel and Polley, all "infants" -- i.e under age 21. Roxana was to get her one-third dower and the children each their one-ninth share of the remaining estate. The minor chidren were represented by William Morgan, their next friend.
By February, 1798, when a distribution was made, Francis Settle was "now of age" and got some slaves, some cattle and some cash from the sale. Each of the seven under age children got one or more slaves and some of the cash from the sale. John Mauzy, George Settle and Henry Carter were the three commissioners who divided the estate. The final decree was January, 1799.3 In July 1804, Richard Harvey and his wife Nancy Settle filed a Chancery bill whiich recounts, in part:
"That about the year 1793 the father of your oratrix Edward Settle died intestate leaving a Widow Roseanna Settle and nine children to wit your oratrix Nancy the complainant & William, Francis, John M. Edward & Sally & Samuel & Polly Settle yet infants under the age of twenty one years and Elizabeth since intermarried with John Fishback all of whom together with ---?-- administratrix your orator and oratrix pray may be made defendants to this bill .... " The estate had included several negroes (in Feb. 1798) and a Negro man named James had been alloted to William in 1793 as well as several to Rosanna as dower. In 1798, other slaves were distributed to the other eight children. In 1798, William was of full age and agreed to take the slave James as his full share of the slaves that were left by their said father. Since this distribution included infants and unmarried females, it may not have been binding so this bill requested the court to make it so. This was done, the defendants William Settle, Francis Settle, Edward Settle, Sally Settle, Samuel Settle and Polly Settle and John M. Settle "having failed to appear", although they were given another month to show cause the contrary. The suit abated as to the Defendant Rosanna Settle. One paper is endorsed "Executed on Jno. & Edward Settle, Wm., Sally, Polly & Saml. Settle, no Inhabts. & Francis Settle, Decd." In March, 1807, Mr. John M. Settle was addressed as Executor of Rosanna Settle. On 28 March 1808, a deposition was taken from George Settle in which he "says he has heard the said Rosanna Settle say in her life that she did not know what she could have done without the assistance of her daughter Nancy & her family, or words to that effect and from thiis deponents own knowledge he is able to say the he thinks the said Nancy Harvey while she lived with her mother rendered services to the family at least equal to the expense of her board and that this deponent would --?-- have been willing to have received her in his family ---?--". He was unable to say that he had heard Rosanna say the the services by Nancy Harvey were equal to her board or one half of her board.4 The estate of Edward Settle was the subject of another Chancery case in Fauquier County, Virgina.
"At a Court of Quarterly Sessions, continued and held for the County of Fauquier, the 25th day of May, 1813.
"Upon the Petition of William Settle, John M. Settle, Edward Settle, William Fishback and Betsey his wife, late Betsey Settle, Richard Harvey and Nancy his wife, late Nancy Settle, Samuel Settle, Jesse Fishback and Polly his wife, herirs Edward Settle, deceased, setting forth that the said Edward Settle died seized of a certain tract of Land in the County of Fauquier, leaving the petitioners and Francis Settle, his only children and distributees and that the value of the share of each distributee does not exceed one hundred dollars, and that the said Francis has departed this life intestate, leaving the following children, to wit -- Morgan Settle, Edward Settle, John Settle, William Settle and Nancy Settle, all of whom are infants, and resident of the State of South Carolina -- It is ordered that the said infant children of Francis Settle appear here on or before October Court next, and shew cause why the said land should not be sold according to the Act of Assembly in such case made and provided, and that a copy of this order be inserted for eight weeks successively in some newspaper printed in the town of Fredericksburg.
Teste. H. H. Compton, Clerk"
A copy of this clipping is in the Chancery Court file, along with the affadavit of Timothy Green that this petition had appeared in the Va Herald two months from 5th June 1813.5
