in the family of William S. Hutchings.12
     The following petition was filed on 15 Dec 1915 in the probate court of Bennington County, Vermont:
"To the Hon. Probate court within and for the District of Bennington aforesaid:
"Come your petitioners, Alice M. Hutchings and William S. Hutchings, her husband, of Moosic, in the County of Lackawanna and State of Pennsylvania; Mabelle McMillan and Charles MacMillan, her husband, of West Pittston Borough, in the county of Lackawanna and State of Pennsylvania; Jessie F. Houser and Samuel Houser, her husband, of Dallas Township in the County of Luzerne, and respectfully show to your Hon. Court: --
"That your petitioners, the said Alice M. Hutchings, Mabelle MacMillan and Jessie F. Houser are daughters, and comprise all the heirs at law to the estate of Margaret M. Olds, late of Moosic aforesaid deceased;
"That the said Margaret M. Olds was a daughter of Mason Cogswell Morgan and Martha Safford Morgan, his wife, late of Bennington in said District deceased, and sister of Harriet Elmina Morgan and William R. Morgan, late of Bennington aforesaid, deceased, children of the said Mason C. Morgan and Martha S. Morgan;
"That the said Margaret M. Olds departed this life on the 11th day of July 1910, leaving no will and leaving no property in the jurisdiction of her domicile at Moosic aforesaid and leaving no persons surviving her interested in her estate other than your petitioners;
"That no administrator has heretofore been appointed upon the estate of the said Margaret M. Olds;
"That the said Alice M. Hastings; Maybelle MacMillan, and Jessie F. Houser, are heirs -at-law to the estates of Mason C. Morgan, Martha E. Morgan, Harriet Elmira Morgan, and William E. Morgan, all in process of administration in your Hon. Court; and are also entitled to the distributive share of the estate of the said William R. Morgan devised and bequeathed, in and by his last will and testament, now pending for probate in your Hon. court, to the said Margaret M. Olds. . ."
The claim made in this case was that a deed made by Margaret M. Olds to William E. Morgan for her share of the estate of Harriet E. Morgan was not valid because Margaret had been incompetent at the time it was made and therefore the Vermont property of Margaret M. Olds should be turned over to Henry B. Filmore. This was apparently done and Filmore was made administrator of Margaret's estate.13

She was buried in Vermont on 14 July 1910.
    Her death date has been misstated here. When the Doctor filled in the form here, he used a pre-printed form with the date pre-printed as 190_ and added in a zero for 1900. Later he said he had attended her from June 15 1901 to July 11 1901, adding only the final digit to the preprinted form. He signed on July 11 1901 in a similar manner. Below that, the undertaker reported that the deceased was buried in Vermont on July 14 1910, striking out the 0 on the form and adding 10. The registrar signed the certificate on July 12, 1910 by marking out the preprinted 0 and writing in the 10. Elsewhere her birth date was given as Sep 30, 1828 with the 8 written over a 7. Her age is given as 82 years, 9 months, 11 days with the final 1 written over a 2. This gives me a calculated death date of 11 July 1911. Using other records, I have placed her birth in 1827 and death in 1910. Someone wrongly corrected the birthdate here and the Doctor was confused about how to use the preprinted form in the new decade.

In the name of God, Amen. I, William Morgan, Serv. Of the County of Lincoln
and State of Kentucky, being weak and lo, but of sound mind and judgment do
make this my last will and testament in the following manner. __________it
is my will and desire that all my just debts and funeral expenses be first
satisfied and paid. Item as a provision for my loving wife's subsistence
after my death I lend unto her during her life two hundred acres of land on
Skagg Beaver Creek bought of Swearingen together with the following slave to
wit: George, Lewis, James, Bel, Sarah, Summerset, Young Daniel, and George
with their increase, also two serviceable horses, one large Wagon and gear,
four chairs, one feather bed and furniture. Also one forth part of all my
cattle, sheep, and hogs, the same part of all my household and kitchen
furniture, carpenter tools, plantation tools, nails, locks, hinges, and steel
and at her decease, it is my will and desire that my son, Joseph, have the
two hundred acres of land with the improvements and old George to him and his
heirs or legal representatives the balance of said slaves and their increase,
stock, wagon and gear, household and kitchen furniture, plantation tools to
be equally divided among my five children to wit: James, William, Joseph,
Daniel, and Salley and my daughter Hannah Bruce's children, giving them the
sixth part. Item to my son, Charles, I give and bequeath thirty shillings as
I have paid him three hundred and eighty six pounds, fourteen shillings his
receipt. Item whereas I hold three thousand acres of land near the mouth of
Licking it is my will and desire that the same shall be disposed of as
follows to wit: to my daughter, Mary Settle, I give one fifth part of said
tract, one Negro boy named Jacob, one Negro woman named ______, and all her
increase. Item to my daughter Elizabeth W. Carmack, I give and bequeath one
fifth part of said tract of land and one Negro girl named Hanna (?) And all
her increase. Item to my daughter, Phebe Fishback, I give and bequeath one
fifth part of said tract of land, also one Negro woman named Suckey, one
Negro man named Sawney (?), and their increase on boy named Jack. Item to
my daughter, Alice Fishback, I give and bequeath one fifth part of said tract
of land, one Negro girl named Alice, and all her increase to them and their
heirs or legal representatives the said slaves being now in their possession.
Item I lend unto my daughter Rosannah Settle one fifth part of said tract of
land during her life also one Negro girl named Linny and all her increase she
being now in her possession and at her death it is my will and desire that
the said Negro girl and increase descend unto her daughter, Polley Settle,
and in case her said daughter, Polley, shall depart this life withoutlawful
live ishew (?issue) it is then my further desire that the said Negro and
increase descend to her surviving sisters she may have to whom I give and
bequeath to her and her heirs forever and the said one fifth part of land as
aforesaid descend to all the surviving children of my daughter, Rosanna, to
them and their heirs forever. Item a tract of land on the water of the big
bone lick creek and on other branches of the Ohio containing seventeen
thousand, six hundred and four acres. It is my will and desire to dispose of
said land among my five children to wit: James, William, Joseph, Daniel,
Salley, and William Bruce in proportion as three acres to each son as
aforesaid to two to my daughter Salley and two to William Bruce the said
Bruce to have it during his life and at his decease to bequeath the said land
to the children of Hannah Bruce to be laid off in equal ____ as near as may
be to each of my said five children. I give and bequeath the same to them
and their heirs or legal representatives. Item and whereas I hold fifteen
hundred acres of land being on Skaggs Beaver Creek bought of Swearingen, I
shall dispose of as follows to wit: to my son James I do give and bequeath
two hundred acres of said tract, one feather bed and furniture to him and his
heirs or legal representatives. Item to my son, William, I do give and
bequeath two hundred acres of said tract to him or his heirs or legal
representatives. Item to my son, Joseph, I give and bequeath one hundred
acres of said tract besides the two hundred acres I lent my wife which heis
to have at her decease. And also one Negro man named Daniel, one woman named
Caty Cary and her three children, Harry, Priss, and Phebe. Also one Negro
woman named Earlen and Polly and all their future increase and all my wearing
clothes to him and his heirs or legal representatives. Item to my son,
Daniel, I give and bequeath two hundred acres of said tract to him and his
heirs or legal representatives. Item to my daughter, Salley, I give and
bequeath two hundred acres of said tract of land _______ the following
Negroes, Pat, Ben, Stephen, Milli, ___________ and all their increase,one
horse, one cow and calf, one feather bed, and furniture, one iron pot, one
pewter dish, two barons, six pewter plates, six knives, and six forks for
during her life and the life of her husband in case marry. In case she may
die without lawful live issue, then it is my desire that the said land and
slaves shall descend to my four sons, James, William, Joseph, Daniel, and the
children of Hanna Bruce giving them the fifth part them and their heirs or
legal representatives. Item I lend unto William Bruce during his life two
hundred acres of said tract of land with the following slaves to wit:
Phillis, Harry, Maryan, and Sam, which is now in his possession. Also one
Negro girl named Amelia _______ and their increase and at the decease of said
Bruce, it is my will and desire that said land, slaves, and increase descend
to the children of my daughter, Hanna Bruce, their heirs or legal
representatives. Item to James Withers, husband of my daughter Frances
Withers. I give and bequeath one Negro woman named Hannah and her child
Caroline to his own proper use and behoof. I also lend said Withers two
hundred acres of said tract of land _____ mentioned if he will except ofit
at the division of said tract and settle on it himself on his giving bondand
sufficient security for his not selling, renting, or farming said land and at
his decease or at the division if he will not except the terms
before mentioned, I do give and bequeath the same to my Daughter, Salley and
the children of my daughter Hanna Bruce deceased giving Salley the onehalf.
I also lend said Withers the following slaves to wit: Chandler, Sharlot,
William, Charles during his life and at his decease, I do give and bequeath
the same to my five children, James, William, Joseph, Daniel, and Salley and
the children of Hanna Bruce deceased, giving them the sixth part the said
Withers not to sell nor swap said slave or slaves so lent nor move them out
of this state unless he has my executor's approbation for in his so doing or
attempting it is my will and desire that his desires are forfeited and said
slaves to descend as I have before mentioned. Item whereas I have money due
one in the state of Virginia in that part where I moved from which said
Bonds, accounts and so forth I left in the hands of my son, William, to
collect for me which said debts I leave to my four sons, James, William,
Joseph, and Daniel in consequence of their paying James Burney what I am
owing him and at my decease and as soon as there can be provision made for my
wife on the land I lent her or at a more convenient place it is my will and
desire that my said four sons pay off what shall be owing at my decease and
advance one hundred pound cash for my wife to be appropriated for her care
and in that case I leave the said tract of land whereon I now live to besold
and the money equally divided between my four sons, James, William,Joseph,
and Daniel and also either of my executors to make a deed to the purchaser
when sold. Item it is my will and desire that my son, Joseph, continue with
his mother after my decease to manage her business and take care of her.
Item it is my will and desire that one Negro man, Harry, and Beck, their
children for to be sold and the money divided among my five children James,
William, Joseph, Daniel, Salley and the children of my daughter, Hanna Bruce
giving them the sixth part. Item all my cottons, linens, and so forth, I
leave to the use of the family. Item and with respect to the balance of my
stock of horses, cattle, sheep, and hogs, household and kitchen furniture,
light wagon and gear, plantation tools, carpenter tools, nails, locks,
hinges, and steals, and all the rest of my estate both real and personalthat
I have not already disposed of except my provender which I give and bequeath
to my beloved wife shall be equally divided among my five children James,
William, Joseph, Daniel, and Salley and the children of my daughter Hannah
Bruce, giving them the sixth part to themselves, their heirs or legal
representatives. Item I constitute and appoint my _________ James,William,
Joseph and Daniel to be the executor of this my last will and testament.In
testimony hereof I have set my hand and seal this twenty-ninth day of April

"Funeral services will be conducted at the Glendale Baptist church at 4 o'clock this afternoon by the Rev. Mr. Lindley and the Rev. Allan Broome and the Rev. Mr. Williams. Burial will be in the Glendale cemetery.
"Active pallbearers will be Oscar Baker, George Burgess, Ernest Alley, Lawrence Thomas, Vic Warren and Will Morgan.
